Welcome to The Small Business Forge! These Terms of Service govern your access to and use of our website, programs, courses, coaching services, digital resources, and any other products or services we offer (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By creating an account, making a purchase, or otherwise using our Services, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into this agreement. If you are using our Services on behalf of a business, you confirm you have the authority to bind that business to these terms.
2. Our Services
The Small Business Forge provides business education and support, including but not limited to: self-paced courses (such as the Founder's Forge and Forge Tracks), digital toolkits and resources, the Small Business Audit, one-on-one coaching, and other programs we may offer now or in the future. The specific scope, format, and deliverables of each Service are described on the relevant product or sales page at the time of purchase.
3. Use of Services
You agree to use our website and Services for lawful purposes only. You may not attempt to disrupt, damage, or gain unauthorized access to our systems or any account that is not your own. You may not resell, redistribute, share access to, or publicly post any of our content, courses, toolkits, coaching materials, or other paid resources without our express written permission. This includes sharing login credentials with anyone who has not purchased the relevant Service.
4. Intellectual Property
All content provided through our Services, including but not limited to text, graphics, logos, videos, templates, toolkits, frameworks, and course materials, is the property of The Small Business Forge and is protected under copyright, trademark, and other applicable intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to use this content for your own personal or business use. Unauthorized reproduction, distribution, public sharing, or modification of any content is strictly prohibited and may result in termination of your access without refund.
5. Purchases and Payments
By making a purchase, you confirm that all payment information you provide is accurate and that you are authorized to use the payment method provided. Prices for our Services are listed at the time of purchase and are subject to change at our discretion; changes will not affect purchases already completed.
Payment plans. Where a payment plan is offered (including but not limited to coaching packages and the Omni Forge), you authorize us to charge your payment method on the agreed schedule until the full amount is paid. Failure to complete scheduled payments may result in suspension of access to the applicable Service until payment is brought current.
All sales are final except as otherwise specified in our [Returns & Refunds Policy].
6. Coaching and 1:1 Services
Our coaching and consulting services, including the Small Business Audit and 1:1 Coaching packages, provide strategic guidance, recommendations, and support based on the information you share with us. These Services are educational and advisory in nature. We do not provide legal, tax, accounting, or financial advice, and nothing provided through coaching, the Audit, or any related Service should be construed as such. You are solely responsible for any decisions you make in your business as a result of our guidance, and we recommend consulting a qualified professional (attorney, accountant, financial advisor) before making significant business, legal, or financial decisions.
Coaching packages and the Small Business Audit are delivered according to the scope described at the time of purchase (e.g., number of calls, deliverables, and timeframes). Any additional services beyond that scope, including extensions or additional sessions, are not included and may be available for an additional fee at our discretion.
7. No Guarantee of Results
We do not guarantee specific outcomes, income, growth, or business success from your use of our programs, courses, toolkits, coaching, or any other Service. Your results depend on a variety of factors including your individual effort, market conditions, industry, and circumstances outside of our control. Testimonials and examples shared on our website or in our marketing reflect individual experiences and are not a guarantee that you will achieve similar results.
8. Disclaimer of Warranties
Our Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the availability, accuracy, reliability, or fitness for a particular purpose of our Services. We do not warrant that our Services will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the fullest extent permitted by law, The Small Business Forge, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of our Services. Our total liability to you for any claim arising under these terms shall not exceed the total amount you paid to us for the Service giving rise to the claim in the twelve (12) months preceding the claim.
10. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when using our Services, including during coaching engagements and the Audit process, as the quality of our recommendations depends on the information you share.
11. Termination
We reserve the right to suspend or terminate your access to any or all of our Services at any time, without notice, for conduct that we determine, in our sole discretion, violates these terms, is unlawful, abusive, or harmful to us, our staff, or other users. Termination for violation of these terms does not entitle you to a refund.
12. Dispute Resolution
If a dispute arises out of or relating to these terms or your use of our Services, you agree to first contact us atĀ support@thesmallbusinessforge.comĀ to attempt to resolve the matter informally.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in the United States of America, Arizona, and you consent to the jurisdiction of such courts.
14. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Material changes will be reflected by an updated "Last Updated" date on this page. Your continued use of our Services after any changes constitutes your acceptance of the revised terms.
